This is an Agreement Between Mantis Computing and all Clients.

Activities Subject to Immediate Suspension/Termination.

Any hosting account that is used for Illegal, Abusive or Unethical Activity may be immediately suspended/terminated by Mantis Computing without warning to you. Any misuse or overuse of the server will result in immediate suspension/termination of an account. Illegal, Abusive or Unethical Activities include, but are not limited to inclusion of or linking to, pornography, mp3's, obscenity, nudity, violations of privacy, hacking, irc related scripts and programs, non approved server scripts, eggdrops, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by Mantis Computing. You agree to indemnify and hold Mantis Computing harmless from any claim resulting from your publications or use of Illegal, Abusive or Unethical materials. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 12-hour period after discovery, we are not required to give notice before suspending/terminating your use of our services if, in our discretion, your use is or results in Illegal, Abusive or Unethical activities. If a hosting account is terminated/suspended, the regular monthly fees still apply. Each individual hosting account is allowed 1 main domain name with all additional parked domain names pointing to the main site of the main domain, unless otherwise specified, using addons, or parked domains. Mantis Computing reserves the right to suspend/cancel/terminate any account at any time for any reason. There will be no tolerance of any abuse of any of our support methods, which will result in immediate suspension.

Public Nature Of The Internet

Please understand that all information submitted on the hosting account shall be considered publicly accessible. Important and private information should be protected/backed up by you. Mantis Computing is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use.

Unsolicited Electronic Mail

You are expressly prohibited from sending unsolicited bulk mail messages ('junk mail' or 'spam'). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. In accordance with the CAN-SPAM ACT of 2003 S. 877, such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. Mantis Computing reserves the right to immediately suspend or terminate your use of our service if we discover such activity. Further, you agree to indemnify and hold Mantis Computing harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using Mantis Computing services for spamming will be immediately subject to a 500 GBP cleanup/network abuse fee.

Service Fees

All payments are due on time, without exception. Any failed charges on an invoice are subject to a 1 GBP service fee. Accounts with any past due invoices are at risk of suspension and late fees. Any account suspended for more than a 30 day period will be terminated, by Mantis Computing, without backup.
Third Party Script Assistance
Mantis Computing retains the right not to assist clients with third party applications. This includes any script uploaded by the client or installed using Plesk. Any assistance, support, or troubleshooting provided by Mantis Computing for ANY third party script or application will be subject to a 25 GBP service fee

Account Cancellation

In the event you cancel your service, you will be charged in full for the entire month in which you cancelled your service. Account cancellations for accounts with a negative balance will be passed on to collections, and all services rendered to the party with the negative balance will be terminated, including, but not limited to, domain registrations. In the event you have elected to prepay, subsequent additional months, Mantis Computing retains the right to charge you an administrative fee of no less than 17% and deduct the administrative fee from the subsequent, future months' Service Fees before refunding them to you. There is a 10 GBP administrative fee for any illegitimate chargeback’s placed against Mantis Computing. Any illegitimate chargeback’s or threatened illegitimate chargeback’s are grounds for immediate account cancellation, and the amount passed on to collections.

No domains will be transferred out whilst there are any outstanding invoices on the account.

Backups

Mantis Computing hosting accounts include a nightly backup service, however these backups are for Mantis Computing administrative purposes only, and are in NO WAY GUARANTEED!
Customers are responsible for maintaining their own backups on their own personal computers. Mantis Computing does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on Mantis Computing part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.
 
We do however have a backup system in place that if anytime the server crashes and information is lost we will restore the backup free of charge to the client. You must request this via support ticket.
 
If you need a backup restored when there was no fault of any Mantis Computing Servers we will levy a charge of 30 GBP and charge this to your next invoice.

Refunds

Mantis Computing will provide absolutely no refunds on services rendered, after your account has been active for 30 days.

Credits

Refunds will not be issued on accounts where a credit/upgrade/downgrade has been issued, and accepted by you as a resolution.

Domain Names

Domains will not be refunded under any circumstances. One registered we are unable to delete it so you should be careful when registering a domain name.

Suspended Accounts

If you violate any of Mantis Computing terms and conditions we will suspend your account until we can reach an amicable resolution to the dispute. If you have a late payment due we will not reactivate the account until payment has been received. If you choose to not pay and there is a couple of month’s worth of invoices we will pass all accounts onto collections.
Mantis Computing reserves the right to modify this agreement at any time.

Free Domains

A free domain name is offered with our webhosting packages.
The domain name is only free for the first (1st) two (2) years, after that normal renewal fees will apply.

Affiliate Scheme

The Affiliate scheme does not apply to domain name purchases.
An affiliate's credit can be off-set against their own invoices as long as the minimum amount of £30 has been reached.
Withdrawals can be only made when the affiliate account has a minimum credit of £30 and all incoming payments are cleared funds.

Support Tickets

We operate a support ticket system for all support, billing and website development issues.
This is based on one ticket per issue. Tickets with more than one issue will be deleted as this leads to much confusion.
Tickets that are waiting for a customer reply/update will be closed if no response is made within 7 days and it will be assumed that the issue has been resolved.
Tickets that are flagged as 'High Priority' and are not of a 'High Priority' nature will be downgraded to 'Normal' priority.
We reserve the right to close a ticket at any time, a closed ticket can be reopened at anytime by simply replying to it.
We will endeavour, and do not guarantee, to respond to all support tickets within 2 hrs during normal working hours, tickets raised outside of normal working hrs may still be looked into depending on staff availability.

Dedicated Servers

All dedicated servers are the responsibility of the client and the client should ensure all security measures are taken including firewall installation and configuration, antivirus, root kit checks and email relaying is closed.
Should a dedicated server become a security risk or become compromised it may be closed down until such a time it is repaired.
Definition of 'Dedicated': The server is dedicated to you, it is not shared or used by anyone else.
Cancellations: All dedicated servers require 30 days notification of termination, this is due to the licensing as we pay each month for your license, if we don't hear from you we automatically renew your license and this has to be paid for.
Legal action will be taken for overdue invoices were no cancellation notice has been given as per these terms.
